By accessing and using our Website and App, you agree to abide by these Terms and Conditions ("Terms of Use"). These Terms, along with our Privacy Policy and any other relevant policies, form a binding agreement between the customer ("you," "your," "traveler," or "travelers") and TripXL.
Your interaction with the Website, App, and associated services is governed by these Terms of Use, including any policies that are incorporated by reference. When you transact on the Website or App, you agree to be bound by the applicable policies displayed at the time of the transaction. Continued use of our Website and App signifies your acceptance of these terms, which may be updated by TripXL from time to time without prior notice.

TripXL is an online platform that enables users to interact with one another for their travel-related transactions. The Website and App facilitate the booking of travel-related services, including but not limited to flights, hotels, tours, and activities, by providing access to third-party travel agents and service providers ("Service Providers"). TripXL itself is not a party to any transaction between the users and the Service Providers, nor does it control, endorse, or guarantee the quality, safety, legality, or availability of the services offered by the Service Providers.

5) Limitation of Liability
By making a booking through TripXL, you acknowledge that TripXL merely provides a technology platform for booking services and products, and the ultimate responsibility for the execution and performance of these services rests with the respective Service Providers. The ultimate contract of service is between you and the Service Provider.
In this context, you also acknowledge and agree that:

shall not be liable for any loss suffered by you due to the rejection of your visa,
hotel cancellation policies, or any other policies of third-party Service Providers
involved in the product or service you purchase from TripXL.
It is your responsibility to ensure that your passport is valid and eligible for
undertaking international travel. TripXL and/or its affiliates, officers, directors,
employees, agents, or suppliers shall not be liable if your passport is declared
ineligible for entry or exit during or before international travel. Some essential
passport-related guidelines include:
6) Referral Program Terms & Conditions
TripXL reserves the right to modify or discontinue its Referral Program at any time. Any rewards earned under the program are subject to the terms and conditions outlined at the time of participation. The Referral Program is governed by specific terms, which may be updated periodically.
7) Mode of Refund
You acknowledge that refunds may be issued in the form of a credit note or voucher that can be used for future travel, subject to applicable terms. In some cases, refunds may be processed in cash. The mode of refund (credit note or cash) depends on the policies of the travel agent or Service Provider.
8) Pandemic-Related Bookings, Refunds, and Cancellations
The customer acknowledges that during any pandemic, public health crisis, or similar emergency, there may be instances where the Service Provider cancels a booking or refuses to provide services due to health and safety concerns. This may include, but is not limited to, situations where:
The customer further acknowledges that during a pandemic or similar health crisis, there may be frequent changes in guidelines and/or SOPs issued by the Central Government, State Governments, or statutory bodies that must be followed by travelers. The customer agrees to comply with all such guidelines while undertaking any travel. If the customer fails to adhere to the guidelines, resulting in refusal of travel, TripXL will not be liable, and any refund will be processed as per the Service Provider's terms.
9) Indemnification & Restrictions on Refund
The customer agrees to indemnify, defend, and hold harmless TripXL, its affiliates, and their respective officers, directors, lawful successors, and assigns from and against any losses, liabilities, claims, damages, costs, and expenses (including legal fees and interest) arising out of or resulting from any breach of representation, warranty, or covenant by the customer.
TripXL reserves the right to withhold or forfeit refunds if the customer is found violating any of the terms and conditions.
10) Cancellation Policy
TripXL is committed to providing maximum assistance to its customers and, as such, has implemented a liberal cancellation policy. Cancellations will be considered only if the request is made within the specific time frame applicable to the booked service, as outlined in the terms of the Service Provider. However, cancellation requests will not be entertained if the booking process has already been initiated by the Service Provider following communication from TripXL.
Cancellations will not be accepted for bookings made within a certain period prior to the scheduled travel, as defined by the Service Provider's cancellation policy. In the event that the service or product (trip) provided does not match the description on our platform or does not meet your expectations, you are required to inform our customer service team within 24 hours of making the token advance payment. The customer service team will review your complaint and take appropriate action based on their findings. Please note that the cancellation policies of hotels and other Service Providers will remain in effect as stipulated.
11) Force Majeure
TripXL, including its parent companies, subsidiaries, affiliates, officers, directors, employees, agents, suppliers, and their respective successors, heirs, and permitted assigns, shall not be held responsible or considered in default for any failure or delay in fulfilling its obligations under these Terms and Conditions if such failure or delay is caused by events beyond its reasonable control ("Force Majeure").
Force Majeure events include, but are not limited to, acts of war (whether declared or undeclared), sabotage, embargoes, acts of terrorism, riots or other civil disturbances, transportation failures, actions by any government or court or administrative agency, acts of God, fires, explosions, floods, earthquakes, strikes, governmental actions, pandemics, epidemics, quarantine restrictions, or any other similar events or circumstances that are beyond the control of TripXL.
Both the customer ("you") and TripXL are required to use their best efforts to mitigate, overcome, and offset the impact of any Force Majeure event. Once the event causing the Force Majeure has ended, the obligations under these Terms and Conditions shall resume in full force. However, a Force Majeure event does not absolve either party from obligations that were due prior to the occurrence of such an event.
12) Transaction Privity Policy
TripXL provides the Website and App as platforms that facilitate interactions between travelers and third-party travel agents or service providers for organizing travel. TripXL itself is not, and cannot be, a party to any transaction between travelers and these third-party service providers. Therefore, TripXL does not control, endorse, or guarantee any aspect of the transactions conducted through its platforms.
All commercial and contractual terms, including but not limited to price, payment methods, payment terms, date, period, mode of delivery, warranties, and after-sales services, are strictly between the traveler and the travel agent or service provider. TripXL does not participate in or influence the offering, acceptance, or execution of such terms.
By using the Website or App, you acknowledge that TripXL’s role is limited to providing a platform for access to various travel services offered by third-party travel agents. The contract for the sale of any products or services is strictly between you and the travel agent or service provider. TripXL is not a party to such contracts and does not assume any responsibility for their fulfillment.
TripXL, along with its parents, subsidiaries, affiliates, officers, directors, employees, agents, suppliers, and their respective successors and assigns, shall not be liable for any direct, indirect, punitive, incidental, special, consequential damages, or any other damages whatsoever. This includes, but is not limited to, damages for loss of use, data, or profits arising out of or in any way connected with the use or performance of the Website or App, or for any deficiencies in services provided by any person (including airlines, travel agents, tour operators, hotels, or similar agencies) engaged through the Website or App.
TripXL makes no representations or warranties regarding the legal title, creditworthiness, identity, or other attributes of any travel agent or service provider. It is your responsibility to independently verify the authenticity and reliability of any particular travel agent or service provider with whom you choose to engage. You are advised to use your best judgment in such matters.
TripXL shall not be liable for any delays, non-performance, or partial performance of its obligations due to causes beyond its control, including but not limited to acts of God, war, terrorism, civil unrest, government actions, strikes, transportation issues, or other similar causes. In the event of such a situation, TripXL will provide prompt notice to the affected traveler as circumstances permit.

Your privacy is extremely important to us. Upon acceptance of these Terms of Use, you confirm that you have read, understood, and accepted our Privacy Policy, which is incorporated herein by reference.
14) Customer’s Responsibility
TripXL values feedback and contributions from its users. However, you bear full responsibility for the content of any submissions you make, including but not limited to reviews, comments, or other content posted on this Website, on any other website, on social media platforms, or through any other available medium.
You agree not to post, transmit, or publish, or continue to post, transmit, or publish any content related to TripXL or any of its subsidiaries or affiliates that:
You understand and agree that any violation of this policy may result in legal action by TripXL to protect its reputation and interests. TripXL reserves the right to remove any content that it deems to be in violation of this policy and to take any necessary legal action to prevent further violations.
